CONSTITUTION
ARTICLE 1 - THE ASSOCIATION
Section 1 - NAME
The organisation existing under this constitution shall be known as the WORLD ORGANISATION FOR MODEL CAR RACING (WMCR).
Section 2 - PURPOSE
The purposes for which the WMCR is created are:- to promote the hobby of Tethered Model Car Racing as an amateur sport; to cultivate friendly relations between all model car personnel regardless of any political or religious persuasion; to provide competition rules for the conducting of World Championships and International Competitions; to issue sanctions for authorised international race meetings. All of these functions shall be carried out on a non-profit basis.
Section 3 - ADDRESS
The home address of the WMCR shall coincide with the accepted mailing address of the Secretary. Upon changing officers of the WMCR, the membership shall be advised promptly of the new mailing address.
Section 4 -
The WMCR only consists of national associations.
ARTICLE 2 - MEMBERSHIP
Section 1 -
Membership shall consist of the Federation Europeenna du Modelisme Automobile (FEMA), the American Model Race Car Association (AMRCA) and the Tethered Race Car Association of Australia (TRCAA). One representative from each of the above Associations shall make up the Board of the WMCR
Section 2 -
New clubs or countries within the ambit of any of the three continental associations mentioned in Section 1 above, who wish to become a member of the WMCR, shall first apply for membership to the governing body within their respective continent. Membership of FEMA, AMRCA or TRCAA will automatically grant membership of WMCR through those Associations. Continents outside of Europe, America and Australia who desire to become members of the WMCR shall make the request in writing on the approved form. (See Form #1 “Application for Membership.” The WMCR reserves the right to refuse membership to any continent for any cause.
ARTICLE 3 - DUES
Section 1 -
Membership dues shall be based on the operating costs of the WMCR and shall be determined every three years by a vote of the regular members. Dues for the year are payable in full on the first day of January. Should excessive costs be experienced in transferring funds internationally, it is in order for each Associarion to hold its dues for three years, so long as they are forwarded to the Treasurer in sufficient time for a financial report to be prepared for submission to the Tri-annual General Meeting held in conjunction with the three yearly World Championships. The Treasurer shall be advised in writing, by its members, that their yearly dues have been collected.
Section 2 -
Dues from membership and any further revenues, are exclusively to be used for the interests of the WMCR.
ARTICLE 4 - RESIGNATION AND REINSTATEMENT
Section 1 -
At any time, a member Association may resign from the WMCR. Any member who desires to resign should do so in writing with the letter addressed to the Secretary, stating the effective date of its resignation, and the reasons for its action. Its interest in the property and /or assets of the WMCR terminate with its resignation
Section 2-
Should the Continental Association of a member of the WMCR be dissolved, then the membership of that Continental Association of the WMCR ends automatically. The WMCR should be informed without delay by the Continental Association of its dissolution.
Section 3-
If a Continental Association desires to be reinstated, it may make a request for such action, accompanied by its dues in full for the current year.
ARTICLE 5 - OFFICERS
Section 1 -
The officers of the WMCR shall consist of a representative from Europe (FEMA), America (AMRCA) and Australia (TRCAA) and they shall be known as Board Members.The Chairmanship of the Board shall rotate between the three members and shall be the representative from the Continental Association that is to host the up-coming World Championships. The position of Secretary shall also rotate and shall be carried out by the current Chairman of the Board. The position of Treasurer shall be a Board appointment and shall be a member of one of the three Continental Associations. The Treasurer shall handle the financial matters of the WMCR and establish a special bank account in the name of the WMCR for such purposes. He or she shall be responsible for keeping a detailed account of the receipts and disbursements and be prepared to render a financial statement when called upon to do so.
Section 2 -
Regional representatives may be appointed by the Board, to assist it in a particular portion of the world when such action appears to be in the best interest of the hobby.
Section 3 -
Committees may be appointed by the Board to handle specific assignments in connection with the operation of the WMCR.
Section 4 -
All Board members shall be elected and serve in their respective offices, starting on the first day of January following the year in which the World Championships were held.
Section 5 -
Candidates for office shall be nominated in writing by their Continental Associations.
Section 6 -
After nominations have been received, the Secretary of the WMCR shall advise its members, the names and addresses of the office bearers for the next three years.
Section 7 -No elected officer shall succeed himself for more than three (3) consecutive terms. An officer may serve three consecutive terms, skip a term, and then be re-elected to the same office.
Section 8 -
All officers shall serve without salary.
ARTICLE 6 - DUTIES OF THE OFFICERS
Section 1 -
The Chairman of the Board shall be present at all regular and special meetings and call the meeting to order. He shall announce the business at hand, maintain order, explain and decide questions of order, appoint committees, recognise speakers, call to vote all questions regularly moved, announce results, and sign orders to the Treasury.
Section 2 -
The Board Members shall be present at all regular and special meetings and shall assist the Chairman in explaining and deciding questions of order, the submission of motions and in the general running of the WMCR.
Section 3 -
The Secretary shall conduct all the business of the WMCR in its normal operation and maintain records to clearly document the business activities of the WMCR. He/she shall keep minutes of the tri-annual business meeting and forward a copy of the minutes to its members within four weeks of the meeting. He/she shall handle all correspondence addressed to the WMCR, issue international sanctions when in order and maintain records of world record speeds in the various car classes. He/she shall care for property entrusted to him/her and turn it over to his/her successor in good condition.
Section 4 -
The Treasurer shall handle the financial matters of the WMCR and establish a special bank account in the name of the WMCR for such purposes. He/she shall be responsible for keeping a detailed account of the receipts and disbursements, and be prepared to render a financial statement when called upon to do so.
Section 5 -
In the event of the resignation or death of a member of the WMCR Board, the Continental Association concerned shall nominate the name and address of a replacement as soon possible.
ARTICLE 7 - SANCTIONS
Section 1 -
The WMCR representative for each Continental Association will issue sanctions for race meetings in its member countries.
Section 2 -
The request for sanction dates must be made by December 31st. for races to be held during the following year in time to allow for processing and their circulation to all members.
ARTICLE 8 - WORLD CHAMPIONSHIP RACE
Section 1 -
Once every three (3) years, a World Championship shall be held for each class recognised by the WMCR. The World Championships shall rotate around the various Continents as follows:- A European Country - Australia - a European Country - U.S.A. - a European Country - Australia etc. The nominated Continent shall advise the WMCR of the location and the date of the next World Championships within 12 months of the completion of the previous World Championships so that WMCR can advise its members accordingly. In the event of a continent being unable to conduct a World Championships when their turn comes up, then it shall be offered to the next continent in line.
Section 2 -
The date selected for the World Championships shall be selected by the host country.
Section 3 -
The World Championships shall be conducted as a stand alone competition and not operated in conjunction with a country's national championships.
Section 4 -
Supervision of the running of the World Championships will be carried out by the host country and the host club on behalf of the WMCR.
Section 5 -
The WMCR shall furnish place medals for the successful drivers in a World Championship.
ARTICLE 9 - TRI-ANNUAL BUSINESS MEETING
Section 1 -
The business meeting will be held every three (3) years in conjunction with the World Championship competition. It shall be arranged at a time and place in the host city convenient to the members of the WMCR Board attending the meet. A detailed agenda shall be forwarded to all member Associations at least 3 months before the tri-annual meeting. Matters of interest pertaining to the operation of the WMCR will be presented by the various Board Members attending and will be fully discussed. Motions will be heard and discussed and voted upon.
Section 2 -
Matters requiring investigation and study before presentation at the business meeting may be re-assigned to a special committee of competent members prior to the regular meeting. Their findings and suggestions will then be presented to the members at the general meeting for further discussion. The findings of such special committee shall not become effective until the matter has been presented to the Board for a vote in the manner as described above.
Section 3 -
The Order of business at the official tri-annual meeting shall be:
1. Call the meeting to order
2. Acknowledgment of the Board Members present and any apologies
3. Confirmation of the agenda and whether any late items shall be accepted for addition to the agenda
4. Reading of the minutes from the previous meeting and its acceptance
5. Business arising from the minutes
6. Chairman’s report on the last 3 years of WMCR's operation
7. Treasurer's report for the last 3 years
89. Examination of the Treasurer's report by 2 Board members.
10. Reports of special committees
11. Reading of outgoing and incoming correspondence
12. General business
13. Receipt of nominations for officers for the coming 3 year term
14. Ratification of the location of the next World Championships
15. Closure of meeting.
The minutes of the meeting will be posted to all members within 3 months of the meeting date.
Section 4 -
The official languages of the WMCR shall be English and German.
Section 5 -
The Secretary shall forward invitations to attend the Tri-annual business meeting to all Board Members at least 3 months before the event.
ARTICLE 10 - INSURANCES
Section 1 -
Every organiser of model car races shall hold a liability insurance to cover personal and property damage. The organising race association/club is totally liable for damages of all kinds and amounts which occur during training or the racing on it's ground.
ARTICLE 11 - LIABILITIES
Section 1 -
This is a non-profit association organised for the purpose of regulating the sport of model car racing by the issuance of certain rules and regulations. Nothing in this constitution or in Technical Regulations issued by WMCR is to be construed as assuming any responsibility or liability for the actions of the individual members or clubs affiliated with the WMCR through their Continental Associations.
ARTICLE 12 - REQUIREMENTS FOR THE DISSOLUTION OF THE WMCR
Section 1 -
The WMCR shall not be dissolved as long as there remain two (2) Continents in good standing who desire to keep it in operation. If dissolution should take place, all of the outstanding debts of the WMCR shall be settled, its property sold to the person offering the greatest amount for the items, and all monies left shall be divided equally between the remaining financial Continents.
ARTICLE 13 - EFFECTIVE DATE
Section 1 -
This constitution shall become effective at one minute after midnight on the first day of January, 200?.
ARTICLE 14 - AMENDMENTS
Section 1 -
This Constitution of the World Organisation for Model Car Racing shall not be amended in whole or in part, repealed or altered, except upon written presentation of the proposed revisions and a vote of the general membership. A 2/3 majority of all of the Board Members in good standing shall be required to effect any amendments to the Constitution.
